Types of Admissions/Commitments to Mental Health Facilities

Voluntary Admission

  • Patient signs themselves in and out
  • Changes to involuntary if risk to self/others

Involuntary Commitment

  • Due to risk to self/others or grave disability
  • Usually requires confirmation from two physicians (varies by state)

Emergency Commitment

  • Imminent threat to self/others
  • Requires court hearing within 24-72 hours to determine discharge or involuntary commitment
  • Court hearings and admission laws vary by state

Patient Rights

Right to Confidentiality

  • Protected under HIPAA
  • Information shared only with those involved in care, unless patient permits
  • Exception: Duty-to-warn (if patient poses risk to third party)

Right to Refuse Treatment

  • Applies to both voluntary and involuntary admissions
  • Nurses should explain benefits/risks but respect patient choice
  • Exception: Emergency situations with risk of harm may necessitate forced treatment

Right to Least Restrictive Environment

  • Restraints/seclusion as last resort and for shortest duration
  • Alternatives should be tried first
