good day everyone now we will start with an introduction to Islamic law and Juris Prudence to fully understand Islamic law and Juris Prudence we need to understand some basic concepts and this includes Islam Islam which in Arabic means submission or Surrender so the literal meaning of Islam is to surrender to submit in Sharia term minology in its technical definition its meaning varies according to usage and it may mean one of the two things first is when the word is used on its own and is not accompanied by the word Ean Faith or belief it refers to the religion as a whole including both major and minor issues of belief words and deeds as in the verse where Allah says Al Islam truly the religion with Allah is Islam and in another verse Medina and have chosen for you Islam as your religion and in another verse and whoever seeks a religion other than than Islam it will never be accepted of him so in in these verses Islam has been mentioned by itself without any accompanying words so in this sense Islam means the whole of religion the whole religion so handsome Scholars of uh handsome of the scholars defined it as a meaning defined it as mean meaning submitting to Allah by affirming that he is one the Oneness and submitting to him by obeying him and disab Sher in its places and its people so when we talk about Islam and if you see a verse or a Hadith and it has been mentioned the word Islam has been mentioned in a verse or a Hadith without any accompanying words or without the accom uh without being accompanied by Iman then Islam here means the whole religion I hope that's clear second when it is used in conjunction with the word Iman Faith or belief in which case it refers to the outward deeds and words as in the verses where Allah says in its nearest interpretation of the meaning the beduin say we believe say you believe not but you only say we have surrendered in Islam for faith has not yet entered your hearts so there are many Hadith there are many verses in the Quran that we can infer this meaning this uh difference of uh meaning so this two words is what we what they call meaning when these two words come together mentioned together they will have different meanings so if Islam is mentioned together with Iman Islam will mean the outward actions whereas Iman will mean the belief the faith so these are uh these are the ways we uh we can understand Islam how to define Islam and if they are mentioned but if only one of them is mentioned then the distinct meanings of these two words is joined together that's there's also a Hadith where the Prophet Muhammad sallallahu alhi wasallam uh me mentioned or uh telling about the prophet Muhammad wasallam and so he said uh the messenger inah alkari and Muslim it is narrated by that the messenger of Allah s alhi wasallam distributed zakat so this is about zakat amongst a group of people while s was sitting there s said but the messenger Sall alaihi wasallam left a man left a man who I thought the best of them all and did not give him anything I said oh messenger of Allah why did you live out so and so by Allah I regard him as a faithful believer m the messenger sallallah alhi wasallam peace and blessings of Allah be upon him said or merely a Muslim a Muslim man then sad continued I remained quiet for a while but could not help repeating my question because of what I knew about him and I said oh messenger of Allah why did you leave out so and so by Allah I regard him as a faithful believer the messenger again Sall alhi wasallam said or merely a Muslim then s again remained quiet for a while and he repeated this question then again the prophet the messenger sallahu Ali wasallam said or merely a Muslim I give to one person even though another is dear to me for fear that he might be thrown on his face and on the fire so with regard to the prophet's words or merely a Muslim when s said to him by Allah regard him as a faithful believer mean you do not know about his faith all you can see is his Islam in the sense of his outward actions so when the two words Islam and Iman are mentioned together in one sentence each has its own distinct meaning but if only one of them is mentioned then the distinct meanings of the two words is joined together okay I hope that's clear uh regarding the term Islam so when we Define technically what Islam means as we mentioned it's the submission it's to surrender and in uh technical definition we can Define it if it's by itself it's the whole religion itself but if it's mentioned together with uh Iman it means Islam is the outward actions some Scholars of course defined it as I mentioned earlier that Islam means submitting to Allah by affirming that he is one by affirming his and submitting to him by obeying him and disavowing shiism and its people now we will proceed with the five pillars of Islam so Islam is based on five things first is the testimony that there is no diety worthy of being worshiped except Allah and that Muhammad is his servant messenger second and the observance of the prayer establishing the prayer third is and the payment of Zak so uh then then after that the pilgrimage and the fasting of uh the fast during Ramadan so here we can see how simple we can say how simple Islam is and how easy it is for the adherance of this Faith Islam's Islam is based or built upon Five Pillars so these are very easy so for you to enter Islam you just need to utter the testimony of Faith the two testimonies so if you utter this and you believe it in your heart and you act upon it upon its meaning you become a Muslim so this testimony is to call to say I testify that there is no DIY worthy of being worshiped there is no God worthy of being worshiped except Allah and that Muhammad is his messenger and servant he that Muhammad and I testify that Muhammad is his servant and messenger so after uttering this and with a belief in your heart sincere belief you are already a Muslim then so establishing or obser observance of deep prayer so in Islam we only have five obligatory prayers five obligatory prayers in a day and a prayer usually takes five to 10 minutes for each prayer so in total you will only spend a maximum of one hour in a day in your 24 hours in a day as a connection spent praying to Allah subhanahu wa ta'ala so this is not hard 10 minutes 5 minutes uh five times a day so I think the misconception of Islam being a hard religion oh or or not easy to follow is I think this is a misconception so the third pillar of Islam isaka almsgiving so this is the obl obligatory uh alss giving and it is only required upon a Believer if his net savings have reached theab the zakat amount and a year has passed the how so what's important thing uh what is important regarding zakat is to remember that the wealth the SE the net savings the wealth that you have should be should reach the zakat amount the NIS then it should also uh reach the how meaning a a year has passed by so if a year has passed by since your uh savings or your uh your net savings then you'll give 2.5% of your weth it's so small it's so negligible a very small amount it's so easy so if you have uh if you have 40,000 for example 40,000 pesos so you'll give only 1,000 pesos if we follow the uh niss and we based it on Silver how many grams of silver 500 plus then I think it's around today around 18 or 20,000 plus so meaning if you have a net savings around that that your net savings have reach the N is accountable amount then you need to give uh zakat so that's 2.5% next pillar of Isam is s Ramadan fasting of of Ramadan so we have 12 months in a year and we only spend one month this is the obligatory fasting one month for fasting so when we say fasting you stop eating and drinking and having uh and having sexual interaction with your uh spouse with your spouse from dawn to uh sunset from dawn to Sunset so usually that's of course Before Dawn you stop eating once uh uh Dawn arrives so fudger is usually around 1 1 hour to 1 and a half hour before Sunrise then you are allowed to resume eating and drinking after Sunset so when Sunset arrives you're allowed to eat and drink and resume your uh normal uh eating and drinking so that's only for one month in the year one month in a year so you have 11 months you are not fasting on those 11 months so you have 11 months uh you're not required obliged to do fasting so that's uh very easy you only dedicate a month for fasting so that you'll achieve piety so fasting was prescribed upon us like how it was prescribed to those before us so that we may achieve py we might achieve we might we may achieve P then finally Hajj pilgrimage so hjge is required or uh obliged Upon A person who is able so when we say when we say able physically mentally financially able so he can he or she can travel to Mak he or she can Finance his uh travel his pilgrimage and he is mentally and physically able and this is only required this is only uh required once in a lifetime so if you do your hjj properly once it's enough then the remaining Hajj that you're doing the succeeding Hage the other Hage that you'll be doing will not be an obligation and it will be accepted as sunah in okay I hope that's clear the five pillars of Islam now we'll proceed with the six articles of Faith so in Islam Muslims believe or Muslims have these six articles of Faith first of course is belief in Allah belief that there is only one true God worthy of being worshiped any other diety or God that you uh that people worship are not worthy of being worshiped except Allah so only Allah is the one worthy of being worshiped and we believe in his attributes and no creation share with his names and attributes so and also we believe that he is The Sovereign he is the sustainer he is the one who sustained and and maintain the whole universe and all the Creations so that's the belief in Allah that's first is to uh believe that he has names and attributes and these names and attributes were revealed by Allah himself through His prophets and no one shares with his name and attributes and his attributes his name and attributes are nothing like what his creation what the creation uh the attributes of creation and he's the only one worthy of being worshiped and we believe that he is the Malik he is The Sovereign the King of Kings the owner of the universe the sustainer and maintainer of the whole universe so this is our belief in Allah subhanahu waala second is belief in Angels We believe that Allah [Music] subhah has created angels out of light and Angels do not have their own will they only follow what Allah has commanded there third is belief in Divine revealed scriptures so we believe that Allah has sent down scriptures has revealed scriptures to guide mankind together with these scriptures are His prophets we believe that Allah has sent prophets and Messengers to be the model to be to guide the people to guide mankind back to Allah subhanahu wa ta'ala fifth belief in the last days we believe that there is a day of judgment there will be a day of judgment and all of us will be judged will be judged accordingly our actions will be weighted good good and bad and we will be judged and we have our full recompense compensation on that day on our actions whether good or bad and finally believe in Al Al Divine predestination we believe that there is good and bad there's a Divine predestination whether good and bad we believe in it so there's a Hadith uh there's a Hadith when l one day while Allah's messenger sallallahu alhi wasallam was city with the people a man came to him walking said oh Allah's Messenger s alhi wasallam what is belief what is IM the prophet sallallahu alaihi wasallam said belief is to believe in Allah his angels his books his Apostles and the meeting with him and to believe in the Resurrection The Man asked Allah's messenger what is Islam so he continued the prophet replied Islam is to worship Allah and not to worship anything besides him and to offer prayers perfectly to pay the zakat the compulsory charity and to fast the month of Ramadan the man again asked oh Allah what isan what isan the prophet saidan is to worship Allah as if you see him and if you did not achieve this state of devotion then take it then uh take it for granted that Allah sees so these are and among other Hadith and verses from the Quran uh as the basis of the Five Pillars and six five pillars of Islam and six articles of Faith now we'll proceed to the next concept which is Shar Shar Sharia linguistically has two literal meanings first is straight path second is path to Watering Place or hole where animal drink so in linguistic terms Sharia refers to water source which is the source to which people who want to drink come this includes also animals so they drink from it and they they fill their buckets and perhaps bring their animals to drink from it as well the Arabs do not call a water source Sharia unless the water is Flowing without interruption and is visible and can be seen technically Sharia means the laws that prescribed that are prescribed by Allah upon his servants through the tongue of a messenger among his messenger among his Messengers or simply the totality of Allah's commandments so Sharia refers to the entire religion which Allah has chosen chosen for his slaves to bring them forth thereby from the depths of Darkness into the light it it is what has he has prescribed for them and what he has explained to them of commands and prohibitions Halal and Haram whoever follows the Shar of Allah regarding as per permissible regarding as Halal that which he has permitted and regarding as forbidden regarding it haram that which he has prohibited will Triumph whoever goes against the Sharia of Allah has exposed himself to Divine wrath and Punishment Allah AEL says in its interpretation of its meaning then we put you oh Muhammad on an ordained way on a Shar concerning the matter of religion so follow it and do not follow the inclinations of those who do not know okay sorry for that so Shar has the following principle characteristics Divine preserved and eternal comprehensive and uh complete idealistic realistic and practical Sharia is div is a Divine Law because it is from Allah subhanahu wa taala it is eternal and preserved because the source its sources are preserved and eternal and will continue to remain and reach generation after generation it is comprehensive and complete because it encompasses all aspects of life it gives us guidance from the day we are born till the day we die it even relates to us before we are born and after we die and lastly Sharia is idealistic realistic and practical because it deals with human beings as they are it acknowledges their needs and desires and Allah knows the humans he created and knows that they need to eat drink and get married they have materialistic necessities and needs the same way they uh that they have the same way they have their spiritual and emotional needs Allah sub to each of you we prescribed Allah and a method the injunction on Justice in the divine revelation so uh so here we will mention some of the verses uh from the Quran regarding Justice regarding ad and how important it is in Sharia in Islam Islamic teachings first uh Allah subhanahu said so the important thing here is the first part uh in its translation we sent a four time our Apostles with clear signs and sent down with them book and the balance that men may stand forth in Justice second Allah said Allah commands Justice the doing of good and the charity to Keith and King and he forbids all shameful deeds and and Injustice and Rebellion he instructs you that you may receive admonition so another uh verse say my Lord has commanded Justice to do justice Allah has commanded you to render back your trusts to Those whom they are je and when you judge between man and man that you judge with Justice number five we have sent down the to thee the book in truth that you may judge between men as Guided by Allah so be not used as an advocate by those who betray their trust and number six Allah said in its nearest English translation oh you believe oh you have believed Stand Out firmly for just justice as witnesses to Allah even as against yourself your parents or your king and whatever it be against rich or poor for God can best protect both follow not the lust of your heart lest you swerve and if you distort Justice or decline to do justice verily Allah is well acquainted with all that you do so when we talk about Justice there are different forms of justice so justice as respect to people the central notion of Justice in Sharia is based on mutual respect of one human being by another the just Society in Islam means the society that secures and maintains respect for persons through various social Arrangements that are in common interest of all members of the society man as Khalifa Steward or vice chant of Allah on Earth must always be treated as an end in himself and never merely as a means since he is the cream of the creation and the central of the Quran so we always need to respect people we always need to respect man human Allah said in in ver and and we have uh we have bestowed favor upon the sons of Adam third respect for person in Sharia is rooted in the Divine injunctions of the Quran and the precepts of the Prophet Muhammad sallallahu alaihi wasallam so in in Shar when we say respect to people it is rooted in Divine injunctions in the Quran so there are many verses and also Hadith sayings of the Prophet so uh supporting or commanding us to respect all person Allah said the best among you in the eyes of Allah are those who are stronger in tawa the best among you in the eyes of Allah are those who are stronger in piety also the the prophet Muhammad sallallahu alaihi wasallam said there is no difference so there is no difference between an Arab and non-arab and a black and white except by pety EXA by TA by fear of Allah now we will proceed to the domains of sharia so if we classify if we uh further uh divide or classify Sharia we can classify it into five domains of sharia first ISL Islamic beliefs Allah has prescribed laws regarding the correct belief system his servants should have so Allah did not live his Creations without giving them guidance in all aspects of life so from belief to any to all uh rituals and other aspects of life so he has sent Messengers and scriptures and also have in US this innate nature of believing in one God the F so this is uh as we have mentioned all aspects of life has been covered by Sharia so there are laws there are teachings there are guidance of Allah regarding the correct belief system we should have second is so Allah also prescribed laws and guidance on how he should be worshiped so he commanded us to worship him and he also guided us on the correct way on how we should worship Him on how we should worship Allah like what we have mentioned earlier Salah so we have the five daily prayer then zakat we give arms giving charity then s fasting in the month of Ramadan then doing Haj if we are able to third is Al so Shar also contains Al so these are the morals ethics and ethics prescribed by Islam so not just uh acts of worship not just the belief but also the how we how we engage with other people with other creation of Allah and how uh we should uh what manners should we have when we interact with other creations of Allah fourth is Al social transactions or this also include commercial transactions so these are the prescribed laws governing interpersonal dealings how we deal with other people so for example in buying and selling a marriage to divorce Etc then finally penal law these are the penal laws prescribed by Islam for specific for uh for specific crimes so that's and other like at the discretion of a judge now we'll discuss the briefly uh there are are five maid Shar but some Scholars add another one the sixth one so the foundational goal of sharia is to protect this five or these six so all teachings all laws all guidance of Allah is to protect these five these five uh foundational values that needs to be protected and promote to uh so you uh the all teachings and all law in Islam is basically its foundational goal is to protect and promote this five and we include uh also the six so first is religion or faith Dean de second is life naps third is lineage or progeny nle and uh some Scholars uh include honor to the third one lineage so honor and nle some Scholars combine it this uh as one then intellect protection of uh intellect then fifth protection of property or wealth Mal and finally honor protection of owner or ER so these are are the five or six foundational values that the Sharia aims to protect we have to remember that Allah does not prescribe something upon his Creations unless the Mas so this is another term very important term you will encounter it a lot Mas when we say masl it means benefit interest or good the masl that comes out of it is raaj preponderant or outweighs any harm if there is harm likewise Allah does not forbid anything unless the MAF harm or evil that results from it is preponderant or outweighs the benefit or good so this we need to uh have this kind of uh world view that if Allah has prescribed something it meant that the mus in it outweighs any harm if there is harm then likewise Allah also doesn't forbid anything unless the ma the harm or evil in it outweighs any good that uh we can think of if there is any good in it example Allah has forbidden gambling and drinking alcohol alcoholic drinks so we some say that there's benefit in gambling you win you will win uh may you will win and maybe earn from it but this benefit that you see this good that you see is far lesser than the the harm that it causes like also in the case of alcohol you may see that I benefit a lot from it because I forget my problem I feel happy when I get dizzy or what so the harm or evil that it causes far far out ways the benefit that you can think of that you are you you think you can get the good that you can get from so likewise in uh marriage so in marriage there's actually a harm in it because you'll be sharing your resources you'll be taking responsibilities and Etc but the benefit that comes out of it is far more uh heavy far more larg far more greater than any harm that you will uh that you think uh that you will get from it if there's any as as we have mentioned so uh the term muslah earlier is very important ter and there are three categories of is the plural of that's a plural of mas so the the first level the essentials these are the most important thing the so when we theat are the four uh the five that we have mentioned earlier so these are the five the five Essentials so these are the essential M meaning that anything anything that promotes it that protects it becomes obligatory becomes obligation so for you to protect for example religion is to have a uh is to observe prayer to observe fasting in the month of Ramadan and Etc so it becomes obligatory so these actions becomes obligatory becomes wag and also anything that harms religion your religion your faith becomes Haram so so anything that harms or destroy it will become har so for example in uh the protection of intellect so this is the this is the you have to protect your intellect your mind so anything that destroys it becomes Haram like alcohol like uh illegal substances drugs Etc so this this becomes Haram anything that causes uh negative uh or causes harm to your intellect it becomes har then next level is haat haat or Necessities or complementary so haat these are things that uh these are Mas that not on the level of the but it is also important and if left alone if not protected and uh come to harm it might uh cause it might cause uh it might uh reach the level of the roria okay I hope that's clear then tax are embellishment so outside of the two are just embellishments we will have further discussion on this as this is only an introduction to some of the terminologies and so that you will have uh also your uh you'll have your own research on this but later on we will have one by one all of the terminologies that we have discussed from Islam towards uh Sharia Etc we'll have a more in-depth discussion of this this is just an introduction so uh Allah prescribed laws that will protect the existence of the five M an example Jihad has been prescribed for the protection of religion and Kos is prescribed for the protection of life so if uh your uh religion has been under threat or eminent danger then you are allowed to do anything to protect it likewise to protect life if there's a uh a kind of no fear in uh taking life of innocent people then the state can Implement kasas an Islamic State of course so only these two uh things Jihad and kisas can only be implemented by a state or by an authority that is accepted and have the power to enforce then which will not cause chaos or further chaos further problems so if it doesn't have that prerequisites it cannot implement or it cannot uh order these things to be implemented okay so the essentials the the this essential Essentials are matters on which the religion and worldly Affair Affairs of the people depend their neglect will lead to Total disruption in disorder and could lead to an evil ending these must be protected in all measures that aim at safeguarding them must be taken whether by individual or by the government authorities this is divided into five categories as we have mentioned earlier protection of Dean protection of religion a de is the most important value that must be protected by Muslims it is obligatory upon each and every Muslim to protect his Dean his religion you know religion doesn't uh really uh it's not the proper translation of Dean because then is a much more comprehensive uh than religion so at a personal level and at every level so the Muslim must protect his de the protection of De at a personal level is achieved through the observant observance of different kinds of I different kinds of act of worship as I have mentioned earlier then next is protection of life and naps life is essential and valuable to everyone therefore it must be protected in all circumstances in this respect there is no difference between the life of the rich and the life of the poor between the leader and the subordinates Muslim and Muslims protecting everyone's life is equally important and obligatory to each and every individual in and societies third is protection of dignity or lineage so n and as I mentioned earlier some Scholars combine them so in this case we have combined honor or dignity and lineage the nle one of the essential elements in the life of a person is is his or her dignity Islam is very concerned about the Dignity of a person and emphasizes the importance of protecting dignity protection of dignity includes the protection of individual rights to privacy and not exposing or accusing others of misbehaviors in addition it also means ensuring that the relationship between a man and woman are done resp in a respectful respectful and responsible way Islam has enacted a number of guidelines in order to protect the Dignity of mankind it prohibits it uh its followers from accusing others of Mischief such as committing adultery or other immoral behaviors so honor dignity and lineage is very important value uh very important aspect it is among the uh the [Music] fourth protection of the intellect or mind or the intellect is a great gift from Allah to mankind this is one of the human capacities that differences that differentiates that differentiates man from animals Allah has ordered that everyone should that everyone should uh protect this precious gift from Allah by utilizing the mental for the benefit of all and not for any kind of evil or anything that might lead to destruction and finally protection of man protection of property acquiring property is one of the necessities of mankind everyone has his or her own property and would like to have all the necessary protection and security for his or her property is Islam has ordered that no one should transgress and acquire the property of others without legitimate reasons and without proper contract then the second level is the complementary the had G the complementary interest or Alia on the whole supplement the five essential interests and it refers to those kinds of Interest whose neglect leads to hardship of the individual or community so it doesn't cause uh total Destruction but or but uh it will cause hardship if left uh neglected although it does not lead to the total disruption of normal life there are many examples of ha such as dispensations of legal excuses Ras uh and the Sharia has granted in regards to I for travelers and the SE so example of this is so when you are traveling so when you are traveling there are some uh legal excuses so you are not required to fast even it is obligatory uh you have the option if you're traveling for example in the month of Ramadan you are not obliged to do fasting you can break your fast and just pay uh fast uh what you have missed after you come back even after Ramadan and other uh so this they fall under complimentary so when you have this leveling of this masal so if uh if it doesn't reach the level of thead so uh these are the ha or if it cause hardship if it's neglect course causes hardship uh not not destruction not death for example so these are uh complimentary these are Haan necessities the third is the embellishments or tat the embellishment or tat refer to interest whose realization lead to Improvement and the attainment of that which is desirable therefore the observance of cleanliness in personal appearance and in iada oral virtues avoiding extravagance and measures that are designed to prevent proliferation of false claims in courts Etc falls under the category of T this might level to the lack this uh if we neglect it this might level to the lack of comfort in life okay other sources or other uh rather other General objectives of sh so th studies in the Quran and Sunnah will reveal that apart from the above objectives of sharia there are also other General objectives of sharia these objectives are the following first is educate the individual one of the primary objectives of Shar is to educate individuals all the different injunctions of sharia seek to educate individuals and Inspire them with faith and instill them the qualities of being trustworthy and righteous it is uh through reforming the individual that Islam aims achieving its social goals second upholding of Justice upholding the principle of Justice or adult is another basic objective of the Sharia in the social sphere we have uh mentioned a lot regarding ad earlier ad literally means placing things in their right place where they belong so so it has the same uh translation or or rather it has the same almost the same definition with wisdom placing things in its proper place uh it is to establish a balance by way of fulfilling rights and obligations and by eliminating exist and disparity in all spheres of Life the concept of Justice in Sharia is not confined to the judicial aspects but it covers all areas of life including individual justice social justice and international Justice this is obvious from the objective and comprehensive approach that the Quran has taken towards Justice then the characteristics of sharia we have mentioned this earlier so uh as a kind of review so the Sharia is divine revelation it has its own characteristics and advantages these characteristic characteristics are the special features of this Sharia which differentiate it from other systems of law developed by mankind the character characteristics are as follows it is of divine origin R Islam as a whole is a divine revelation because its primary sources the Quran and Sunnah is divinely revealed Sharia is free from discrepancies and shortcomings Sharia so the implications that the fact that Sharia is from Allah so the implication uh that the uh the implication of sharia being of divine origin are the following first Sharia is free from discrepancies and shortcomings so when we know that the Sharia is of divine origin we it automatically uh will let us know that Shia is free from any discrepancies and shortcomings Sharia is the product uh the of Allah the creator of man kind so it is his Commandments Allah has no vested interest when he revealed the Sharia therefore it is purely revealed for the interest of mankind this is different from any man-made law which has the tendency to be manipulated in order to serve or to benefit the interest of certain group of people the principle of equality Al musat in Islam is a perfect example to manifest free from any discrepancies second implication would be respecting honoring and obeying its commandments so when we know that Sharia is of divine origin people will have respect in obeying the Commandments of Allah as it is a divine order and it is different from any other Commandments others Commandments which came from man it is part of the AA the belief the Creed of Muslim to believe and Obey all the Commandments of Allah as implementing them are part of I Sharia is universal realistic and contemporary it is so the Sharia in all its components is universal realistic and contemporary the belief system in Islam is realistic in the sense that Allah have ordered the Muslims to worship him alone and he has provided many evidences in the Quran and Sunnah about his existence in addition all the Unseen matters which are the pillars of hisam such as the belief in the Divine decree Al is simple and understandable to the aage man this EV this is evident in all rulings of sharia so Sharia propagates protection of interest and rejection of evil Shar propagates a protection of interest and rejection of evil this is evident in all rulings of the Sharia which were revealed for the benefit of mankind at all time an example of the ruling related to
