just purchased a pre-owned car but he received it with expired registration in Texas there's a 5-day grace period to register a vehicle under those conditions but on the very day he purchased the vehicle officer Thompson of the Florence Police Department pulled Joe over for the expired tags as the officer approaches Joe drops his keys out of the driver side window I say fius officer put your hands on the car none of my put your hands on the car none of my windows work sir all right man where's your driver's license um in my pocket sir oh no free change 446 County Texas 27 4018 910 4018 910 all right man go sit on my bumper I'll be at the end just a minute what's going going on what's going on with him it's not normal for people to throw their keys out the window and to get an attitude like that start cussing at the police uh honestly he kind of has a little bit ofer issues yeah yeah apparently but uh okay no he's seen us no he didn't see us but we seen you P out he knew that you were telling us gotcha and so we said finally gotcha are there any weapons in the car no you sure guys see bullets and if if there is just just let me know we do have bullets um but we just shot okay dispatch returns verifying that Joe's license is valid temp all right so I I don't I'm not trying to be difficult I'm about the most chill cop that you'll come in contact with but when he comes starts acting like that the registrations expired that's the reason for the Stop um I don't care about weed I won't even write you guys a ticket over it I don't know if someone's just smoked in here or you guys have a tiny bit it's no big deal either way just be honest with me and I'll get you on your way here in a sec um I have I have a okay but that's you just came I just he's not high but okay so I'm going to check the car um for anything else if if there are there any other drugs in here you sure cuz if you're honest with me it's not not a big deal but if if I find it and you waste my time then that's where I charge people yeah no I only have the grab C okay and okay no meth no pills no nothing okay is your baby sleeping or no okay sorry all I can see is the car seat do you want to um grab him and stand out here with him or do you want to leave him in here I'm not going to take along no I can take him okay do I need to call someone to come pick us out because the registration is expired well no I mean that normally no I wouldn't even to write to a ticket but the way he's acting but yeah it could get towed but I I don't plan on doing that you guys be chill with me I'll I'll get you on your way here in just a minute but if there's any weapons or there's any other drugs just tell me now I don't to my knowledge there is not okay all right okay Officer Tompson pulls a fast one on the passenger by asking her if she wants to leave the baby in the car the question infers that he's going to enter the car to search it without ever having to ask for consent as without consent probable cause would be required fortunately the mere presence of bullets does not provide probable cause as simply seeing a legal item does not inherently suggest criminal activity and as far as the vape pen the device contains thca and is lawful in the state of Texas without evidence of the driver's impairment The Vape Pen alone would not justify the search of the car especially after the passenger claimed ownership of it but the passenger exits the vehicle and before Thompson can start the search job protests and revokes any consent the officer thought he had excuse me officer I didn't get sent to the search of my vehicle oh really turn around put your hands on your back I don't need your consent um may I ask why because I have probable cause uh probable cause of drugs being in your car um again probable cause because what was the original cause for the Stop officer any if any drugs should be found in the car dude shut your mouth dude6 count show them canot be drugs it' be fruit of the poisonous tree officer dude you are stupid dude get in the car dude get in the car can you please put my sh back on no get in the [ __ ] car all right you'll be hearing from my lawyer being detained you just said he's got issues officer Thompson Now searches the vehicle officer Thompson believes the vape pen is what gives him probable cause but this pen is non- psychoactive and has been legal in the state for nearly 5 years backup now arrives and asks what his probable cause is was a uh plane view thing that you saw no she handed it to me oh she handed it to you we I don't want to tell him that because he's got anger issues and he's going to lose his [ __ ] on her but it don't matter but if you want you can tell him but I asked her if there's anything in the car she said I have a TC C handed it to me yeah and then he starts running his mouth about searching the car I I didn't tell him I wasn't going to say your girlfriend gave me the vape pen you know but just want to make sure that officer Thompson will now exaggerate what happened prior to his backup's arrival the keys I'm like oh man get over here fing weird dude well so he he he throws out the keys I ask him to roll down the windows are youing kidding me starts screaming I go hop out of the car dude come back here then he goes on the bumper I Pat him down put him on the bumper then he just keeps running his mouth while I'm talking to her are there any weapons in the car no you sure and I tell him I'm going to search the car start to run his you can't search myu car search my car I didn't consent excuse me officer I didn't consent to the search of my vehicle oh really turn around put your hands on on your back I don't need your consent um may I ask why dude chill out and put him in cuffs put him in the car dude you are fing stupid dude get in the car dude and then he's like oh you'll hear from my lawyer he goes what am I under arrest for I said you're not under Rush you're being detained you know he's we'll talk I just I just want to make sure that on okay yeah dud he's out of control he then goes back to searching the vehicle finding nothing throw the keys out just it wasn't I that and cussing at me for no reason um if you want to get back in the car you guys can give me just m write him some tickets and then I'll get you guys on your way okay okay thank you over the next few minutes officer Thompson writes up a few tickets and eventually Joe is released you want to get him out of get him out I'll get him so he can sign this it came up on the on [Music] that's good just so you know those carts are a felony in Texas if I wanted to be stupid I could take you to jail on a felony okay you're going to receive a citation for possession drug perel and expired registration Joe's case went to pre-trial on the 19th of December for displaying expired registration and possession of paraphernalia Joe maintains that he has the bill of sale and registration for the vehicle and as mentioned earlier the thca device is legal it was not in his possession and claimed by the passenger I attempted to reach Joe to learn the disposition of the case but was unable to make contact but
