Welcome back future criminologists. In this video, I will be discussing the difference between substantive law and procedural law. Substantive law.
Substantive law, literally the substance of the law, which governs how people are expected to behave. These rules or laws define crimes and set forth punishment. They also define our rights and responsibilities as citizens. In criminal cases, substantive law governs how guilt or innocence is to be determined and how crimes are charged and punished.
For example, the revised penal code is a substantive law. Sa revised penal code, doon mo makikita ang iba't-ibang uri ng krimen. Nakalagay na rin dito kung paano mo ito magagawa at ang katumbas na kaparusahan ng ginawa mo. Procedural or remedial law Procedural or remedial law prescribes the method of enforcing rights or obtain redress for their invasions. Procedural laws govern how court proceedings that deal with the enforcement of substantive laws are conducted.
and procedural law adheres to due process due process is a law that hears before it condemns for example yung mga batas na nagsasabi kung kailan mo pwedeng ifile ang isang kaso kanino mo ifafile o sino ang magfafile actually these rules are embodied in the rules of court the rules of court which was promulgated by the supreme court have the force and effect of a law Take note that both procedural and substantive law may be altered over time by Supreme Court rulings and constitutional interpretations.
