you might have heard in the news recently that Oprah got subpoenaed by a court You might have heard that on the Breakfast Club even or something And this case having to do with Russell Simmons and maybe it's something about defamation and maybe it's something about s assault and then there's a documentary involved I looked into it Let's discuss the truth Please do not send any hate or honestly comments of any kind to anyone mentioned in this video on behalf of me or yourself Purpose of this video is to give my commentary and opinion on matters of public concern Thank you All right So the whole case arises as a dispute between Russell Simmons who's the co-founder of Def Jam He's a big music mogul type and then this other person Drew Dixon who in her own right is a power player in the music industry And also she's a power player outside of the music industry There was a brief period of time where she did kind of step away from music and she went and just real quick grabbed her degree her MBA a master's in business administration at Harvard like one of the best business schools in the world So she also talks a lot about her resume and a lot of these lawsuits And she's very impressive I will say Good for her #boss # icon # slay and all of that Okay so it probably won't come as a surprise to you She was always a high achiever She got music industry internships very early in her career and by the time she was 23 years old in 1994 she had landed her dream job and that was the director of ANR at Def Jam Her boss at this job would be Russell Simmons and she said this dream job would very soon very quickly turn into a nightmare It was nightmarish she said even and it was all at the hands of Russell Wendell Simmons So it's very interesting how she describes him in the lawsuit I do think it is important to remember you know she's 23 at the time but also this was 1994 so he was much younger as well I don't know So she says the nightmare started to happen pretty much instantly She starts working there and Russell Simmons would routinely she says try to grope her and uh kiss her And this led her to making attempts to be away from him as much as possible So she would still work with him Obviously that was her boss but she was just kind of trying not to be alone with him and stuff like that So on this one fateful day 1995 she says that he lured her into his apartment He didn't have an office per se at the Dev Jam recording studio So if you wanted to take a meeting with him it had to be in the car in his apartment in his hotel or whatever So it wasn't particularly unusual to take a meeting like that But she had already developed suspicions about being around him or whatever She didn't want him to retaliate against her artists And that's one thing she claims that he was doing was that he would take it out on the artists that she wouldn't do the casting couch or whatever you know type of thing That's what she claims So this this fateful day she gets apparently lured she says into the apartment to listen to music which is her job She does have to listen to the music He says "Okay I got to go to the bathroom real bad." He goes to the bathroom He comes back out the bathroom and he is wearing nothing but we'll say a raincoat you know of sorts Uhoh I can't I can't y'all here's the here's what it says in the lawsuit I just the terms I'm trying to I'm trying to follow the rules Okay He showed up naked wearing a and tackled me to his bed while I screamed and fought and said no and cried So he comes out and you know advances upon her and she denies the advances she says but he continues forward Okay So that was of course if that traumatizing she says they're traumatizing So she says that in an effort to keep her own reputation in the music industry as well as her her artists She says that she tried to sign Kanye West She says in her lawsuit she tried to sign Kanye West and Russell Simmons wouldn't even meet with him because out of retaliation for not um succumbing to the advances I was approached by Londell McMillan an attorney who I knew at that time and Landelle called me and said "I want you to check out Kanye's demo." Like people knew Kanye as a producer at that time right so I went to Landell's office and I met with Kanye in the conference room It was just the two of us Kanye played me his album He like stood next to me and like rhymed every song just to make sure I got every lyric which I loved I was like I love how much he means it He is determined to get from point A to point B I was like and he needs to get there We will all be better off if we just help him get there I set up the audition LA passed in it He didn't just pass in it He told me I sucked at my job He told me I wasn't even close I was like okay can I just tell him cuz he's waiting you know so I told him in my office he's like fighting back tears I was like you know what you shake it off you're going to get a deal You're going to win so many of the Grammys You won't know where to put them You are amazing You're good Don't even think about it And he was what correct Right So she said in an effort to minimize that and because she called Russell Simmons perhaps the most powerful gatekeeper in hip hop And she said not only that but he also it's a very tightknit group It's a close all these gatekeepers know each other And so if I would have crossed Russell Simmons that would have been the end of it I wouldn't have been able to get a job anywhere else So that's why I didn't come forward But then in 2017 there's the Me Too reckoning It happens And she does finally come forward with her public allegations against not only Russell Simmons but also against another music industry power player power mogul La Reed He was the one who was business partners with Clive Davis at Love Face Loveace Records was LA Reed Clive Davis and Babyface which was the record label that signed Usher And then of course from Usher we get Justin Bieber He was signed by Leser and Scooter Braun and the Webs web all over the place All over So LA Reed getting accused of doing some untoward behaviors toward Drew Dixon all the way back in the 1990s So 2017 Drew starts to come forward and she starts to make allegations about things that she had kept secret until then So a few years later by 2020 a documentary comes out about Russell Simmons So a documentary comes out It's one of these meto reckoning documentaries along the lines of that surviving R Kelly debacle Okay So not only did Drew Dixon appear in this documentary it was called On the Record which is so similar to that Britney Spears documentary Yeah Isn't that one called On the Record or For the Record anyway um I mean it is pretty common sounding So they do this on there documentary and in the documentary Drew Dixon she's kind of like the main subject She is featured very prominently and she's kind of the main accuser in this documentary It comes out in 2020 And in this documentary she makes allegations specific allegations about Russell Simmons and about activities that she claims that he did to her of suual misconduct while he was her boss So a couple years ago Drew finally actually sues him in court for these actions under the New York Gender Motivated Protection Act or whatever There was this lifting of the statute of limitations A lot of this stuff had happened so long ago she couldn't sue for it And this is how we have like 20 lawsuits against P Diddy right now from Busby of stuff that happened Traditionally it would be outside of the statute of limitations But there was a window open for like suual assault survivors to make these types of allegations against alleged perpetrators for a short window of time and then the window was going to close back again So when this window opens and before it closes Drew does sue Russell Simmons for the SUL assault false imprisonment intentional infliction of emotional distress and under the gender motivated uh violence act Now to be extremely clear Russell Simmons denies all allegations He claims and he says in his defense he has never had a non-consensual encounter of a asual nature And you know he you know we'll get into more what he says later but he denies all allegations Just wanted to put that in there Well two months ago Drew Dixon's case was dismissed But it wasn't dismissed because the judge found that Drew didn't prove her case It wasn't dismissed because she didn't make the right pleadings It was dismissed on a jurisdictional grounds which is legitimate grounds but it didn't get to be argued over the merits of the case It was just it couldn't be argued in that court That court didn't have jurisdiction And what is very weird to me and there was people in my comments talking about Russell Simmons ran away to Bali Remember that um Aoki Simmons video people were saying he's hiding out in Bali And I don't know why people were saying I'm like maybe he just likes it over there But he does live there He resides in Bali He has a Bali driver's license and he doesn't consider himself to call America home He doesn't consider the United States home I must say America because that's his exact words from a deposition But the case gets dismissed on jurisdictional grounds because or in part because Russell Simmons was found to be a stateless citizen So the case gets dismissed It goes away But all the while throughout this case Drew Dixon and her lawyer the plaintiff they're telling Russell Simmons "You might get it dismissed out of this federal court but if you do we are going to sue you again in state court It is going to start again so you might as well just submit here." And in fact and indeed they they did upkeep their promise when the case was dismissed on jurisdictional grounds just like about two months ago Last month Drew Dixon and her lawyer did bring the case now again in state court So they did make good on that promise So that's two lawsuits right there Right The first one she sues him for s assault and false imprisonment and all that stuff It gets dismissed about two months ago So that was gone ongoing for about a year So then she sues him again Now we're in state court So let's pause on the lawsuits right there and talk a little bit more about that documentary Remember that 2020 MeTo Reckoning documentary and Drew Dixon is like the main star or whatever of it Well originally Oprah Winfrey had signed up to executive produce this documentary which in and of itself is the subject of numerous conspiracy theories and other types of theories in and of itself I have heard people say this documentary I mean it's like the root of a lot of this stuff I've heard people say that it was a hit piece on Russell Simmons specifically to protect some other people or somebody else I've heard P Diddy's name thrown about I've heard Jay-Z's name thrown about I've even heard people alleging in my comment section could be media matters astroturfing bot so take it with a grain of salt but that Jay-Z financed the documentary to diminish the reputation of Russell I've heard this rumor It's a speculation from a bot on the internet but it's just the subject of a lot of online speculation This whole like wait Oprah was like Russell Simmons's like friend or like they at least ran in similar circles and then she's going to executive produce the hit piece People were like "Okay well if you think that that's a fair hit piece in any direction there's conflicts of interest." And then Russell Simmons himself had both publicly and privately pressured Oprah to drop out Both of them have made public statements on this There's this Gail King You can't do one single episode about Oprah Winfrey Not one Was I looking for Gail King no I was not Did I need to come across a Gail King clip no I did not No I did not We were at the same table where Dr What's his freaking name what was his name dr Oh my god it's just rat Dr John Leoop joins us now to discuss I hope you brought your prescription pad I'm telling you a lot of people are very interested I have a friend of mine who's on it who lost 15 lbs in one week What leaf Fuk We're at the same table where Dr Lefuk was sitting We have Oprah saying "No no no Mm- no This 2020 This is like when the documentary is about to come out." She said "I had to pull out." And the title of video is like Oprah Winfrey addressing why she didn't do the documentary or whatever She drops out news lately about the documentary in Baltimore I try not to make news but okay I know You know Oprah told me last night we had dinner and she said "If if I didn't have this book club I would have called in sick today." I would have called in sick I would have called in sick But I do think it's important for people to hear from you personally for you to address it I know that you've released a statement because you decided to take your name off the documentary involving Russell Simmons um and his alleged abuse of women And I think people question why would Oprah of all people do that well first of all I just want to say that um I have lived me too Yeah Since I was 9 years old and was nine sexually assaulted from 9 to 14 and then again at 14 And nothing is harder than standing up for yourself when you're 14 and not being believed And I was not believed by my own family So I stand in support of these women I believe them It was a hard decision because I knew that Russell Simmons had started publicly pressuring me and that me pulling out of the documentary was going to look like I was being pressured So what do you publicly and publicly and privately yes Yes And so what do I say to that is for me and Gail knows this in all experiences of my life and particularly when I'm in a crisis the only question for me is what is the right thing to do for me uh before the public pressure had started before Russell had gone with his Instagram I had gone to the to the filmmakers and I had said to them uh Houston I think we have a problem here because new information had come forward the very first time this was announced And I said I think we need to pull out of Sundance And if we can't pull out of Sundance I'm going to have to take my name off I don't want to have to take my name off because it's going to be a big hol But you said pull out of Sundance so we can get it right Yeah a lot of Sundance cuz I don't care about awards I don't care I just care about getting it right And I think there's some inconsistencies in the stories that we need to look at Russell Simmons has has first of all he's denied It's very vague It's very ambiguous What is she talking about what do you mean you had a difference of what do you mean and then she's kind of throwing shade kind of She's like never do something where you don't have the final creative control And it's like it took you how long to learn that i don't believe Oprah Winfrey never learned that in her life yet You know there's I'm 66 She starts the interview off with So it's like okay that's weird But anyway she says in it like Russell had been publicly pressuring me so I knew if I pulled out it was going to look like I was but that's not what it is everybody She says but then Oprah swears She swears she did not pull out of the documentary because of that Rather it was creative differences Okay So Oprah tells that version of the story Russell tells a totally different version of the story years later The clip you just saw is from 2020 2023 he does this infamous Graham Besser interview And I got to tell y'all we might not be able to play clips of this because I never saw anybody else on the internet quite as bad as copyright claiming I mean there's nothing you can do to these clips So we might not be able to play the whole thing I know how this man is but there's this infamous 2023 interviews Definitely at least be able to put some screenshot Russell Simmons comes out to clear his name on this podcast now And very importantly he appears on Zoom or whatever from Bali He doesn't commit these these voice acts He knew that I'm like why wouldn't he go to Oh I see the the law the legal argument you were prepping to make 2 years later a year later Anyway okay So he tells his side of the story in the interview He says you know some things that are not exactly calling her a liar He's defending himself and he's telling his part of the story He doesn't mention anyone's name but he does reference a group of six people And there were six people who appeared as accusers on the documentary So it kind of narrows it down and he does kind of refer to a main accuser So it it may be pretty obvious who he's talking about Well that's Drew Dixon's arguments that are going to come up in a moment Well on this interview this podcast interview Russell also says the reason he's like "Call Oprah Call Oprah Call Oprah Ask Oprah." The reason she pulled out was because she found inconsistencies in the so-called victims' stories But Oprah had already said that is not she was like specifically disclaimed that that had anything to do with it years before Three years later you have him going call Oprah She'll tell you the reason she pulled out cuz the victims had inconsistencies in their story But Oprah's the three years earlier going I believe the victims I believe them They do kind of seemingly disagree on why Oprah pulled out of the interview whether Oprah believes these people or whether they have inconsistencies or if somehow whether that is reconcilable those two conditions But one thing they do agree on and they agree with each other on is that yes Russell Simmons did pressure Oprah publicly and privately He did admit that he was pressuring her at the time to pull out of the documentary There's a whole new lawsuit that is about to enter the chat This one is not for the SU assault They do got that ones going on and it's got dismissed cuz he was Bali and now there's a state one going on just got started last month Okay there's that That's over there That's about whether he actually did or did not do the s assault But there's another lawsuit a separate different lawsuit now for defamation Defamation This was filed in 2024 And this lawsuit stems from those statements Russell Simmons made on the Graham Besser whatever podcast She's saying Drew Dixon is saying that taking together all his statements when you piece them together he's calling her a liar and saying she's lying and falsely fabricating allegations and that is defamation You know uh one one of these people sued Donald Trump for a similar theory that she came out and said he harmed her He came out and said she's lying and then she sued him for that for defamation So you're not even actually suing for the underlying did it happen or not Interesting So this lawsuit by Drew Dixon is going on now And this lawsuit the defamation lawsuit is where Oprah enters the scene Oprah is not being subpoenaed to my knowledge to my knowledge Maybe she is but the subpoena everyone is talking about from what I'm understanding has to do with this defamation lawsuit Okay So she sued him for defamation like a year ago February 2024 And her bottom line argument is he made it seem like she's a liar He sort of does beat around the bush and he says stuff like "Can I imagine a situation where somebody is thirsty for fame or you know that you're talking about six individuals maybe we just have different memories of things Maybe people left away from these encounters feeling hurt." Like he's he's like yeah could someone have I I could have possibly had more foresomes than others and could possibly you know some of the people left away from that feeling some hurt It's possible you know it's kind of this is sort of it's what's really you just have to laugh or you cry is that like all of these guys are like pawpaw age and they like oh we having to think about like like go play with your grandkids you know get to the golf course Seriously And so Drew sues him Drew Dixon she sues him February 2024 and he immediately files a motion to dismiss motion to dismiss the lawsuit Again this is defamation This is separate from the s assault lawsuit So that's going on at the same time back then And to be entirely fair he makes a strong argument on his motion to dismiss at least at least some of the statements at least some of the statements she seems to be relying on At least some of those statements do appear to not be actionable as defamation He makes strong arguments like he he says you know some of it some of the stuff he's like this is my just my opinion on a matter of public concern This lady went and talked about me on a HBO Max documentary She made all kind I didn't sue her for defamation Like I got to be able to say my side I didn't even say her name was one of his defenses It's obviously you know me and her are the only people that are there So me and her the only people that know what happened She's she's not alleged on you know new actual malice Um issue of public concern a big one cuz there is there's there was an also a New York Times article that Drew Dixon was in It's like look at all these familiar you notice a pattern New York Times hit piece HBO Max hit piece series scorned someone from the past that maybe maybe you never actually spoke to in your life I mean they'll go that far I know firsthand not the New York Times hadn't come for me quite yet but they did Never mind that's a story for another day And he also says a lot of this stuff she's saying defeamation I didn't claim anything To be defamation you have to claim something Is a statement of fact presented as if it were the truth and it's false So some of this stuff is just me saying I might be able to imagine something That's not a claim What do you mean or whatever So when I'm reading through this I'm still you know I'm trying to get to what's the deal with Oprah because that's why I started looking into it Why is everybody talking about Oprah got subpoena i want to know Not minding my business So you have to start reading these lawsuits from the top to going down So I'm reading them I'm going chronologically I'm like okay this is going to trial Defamation is hard to prove Period Period They're hard to win They're just period hard to win for many reasons First amendment all that But defamation by implication is very very hard to win because you're not actually outwardly saying John Doe committed a X crime You know you're saying "Can I imagine that there was maybe six people?" And it's like each step away it gets harder and harder to prove it because it has to be a statement of fact made as if it was a fact not opinion not a belief not a pontification And so I'm like "This case is going far enough to get Oprah involved." I was shocked Act three This is where it hits the fan Okay So the judge in the case sets oral arguments That's like a little miniature trial like a little miniature hearing You go each side has to do arguments The judge has questions And I can imagine the judge would have questions in this case but you don't always have to do that There's not always oral arguments A lot of times in federal court the judge will just decide with no oral arguments They'll read your argument They'll read their argument They'll read the reply argument and they just make their decision on the papers When Russell Simmons and them are involved the judge might to make sure that it's going to survive appeal and not end up right back on their desk again Have some questions So sets the oral arguments for this issue Motion to dismiss not the defamation claim The the motion to dismiss Is any of this even actionable as defamation tell me why this year this just happened two months ago February 5th 2025 A year after the lawsuit was filed after they went through like I said motion to dismiss got filed 30 pages or whatever opposition to the motion to dismiss had to get filed Then Russell Simmons had to file a reply to the opposition to his motion to dismiss Okay so all of this has happened Who knows God knows how much legal bills have already gone into this Oral arguments are set for February 5th 2025 and tell me why Russell Simmons and his lawyer do not show up Crickets I can imagine it I can zoom I can zoom Astral Projector to call it right into that room right now And it's just like court and the the lawyers on Drew Dixon's side their DC lawyers They they traveled I don't remember if they said they got on a train They were like "Your honor we traveled from Washington DC to make oral arguments on this issue We filed these moving papers months ago almost a year He's just his lawyers don't show up either No one shows up The judge ends up this is all on the court record The judge ends up calling his office the lawyer's office Daniel Fish David Fish something fish No answer from the lawyer His receptionist answers and the judge Imagine a freaking judge A federal No no no This isn't federal I think this is in the state court too A judge at any courthouse a judge anywhere federal or not federal but it would be worse of a federal But sitting there calling him couldn't even get him on the phone How important are you Russell Simmons lawyer and then I honestly I could not help but kind of feel a little bit bad for Russell Simmons in all this Imagine you're Russell Simmons and you really are getting sued Maybe he did it maybe he deserves it That's not for me to decide But like you at least you know you're paying this lawyer God knows how much and he don't show up to argue your motion to dismiss a defamation claim whenever whenever he's probably in Russell Simmons's mind you know like he probably feels like I let this lady go out here and say anything she wanted to the New York Times I let her go out here and say anything she wanted to the HBO Max All I wanted to do was three years later go on a stupid Zoom call podcast to say maybe some of these people had alternative what motivations and my lawyer won't even show up That shows you money can't buy peace of mind But then again I mean there's alternative theories and it seems like Drew Dixon's lawyer's theory is they didn't accidentally miss that case They didn't accidentally miss it That seems to be the theory because they were over there in the other court arguing out of the other side of their mouth Over here in this court they were saying certain things about jurisdiction Over there in the other court they were saying certain things about jurisdiction But it all ties up with if they would have showed up to court this day maybe a decision would have been made and maybe it wouldn't have been able to entangle I don't know It seems like maybe the theory is that they were waiting Russell Simmons side was waiting for a certain decision in that other case before they necessarily had to cuz maybe they were going to submit a jurisdiction argument here as newly found information cuz it was newly decided by that other court just two months ago He's a stateless citizen That's a theory His earnest filed on the record declaration is there was accident So the lawyer said he missed it and it was because they didn't get a notification from the court system And the other side Drew Dixon's side is like "So check the docket You needed a notification from the EC court system for anybody from your whole office to know you had court this day." No So court's happening Russell Simmons's lawyers are not there The schedule is starting for 2:00 That's what's on the docket to start the calendar And the judge calls the office no answer And the judge says he's she's going to give or he's going to the judge is going to give Russell Simmons lawyer until 3:15 It was like 2:30 It's going to start at 2:30 We'll put it in here But she was gonna give them like 45 minutes to show on Zoom to log in on Zoom Not even like you have to be in person Just log in on Zoom and do your oral argument on Zoom That's very that's very popular now or it was for a few years I hope it stops being popular It's kind of stupid The fact they never had Britney Spears ever come in person to a court hearing is still troublesome to me Like it's a like the judge didn't want to just see Now she did show up sometimes but I mean like during like the when she was giving testimony and wanting to get out and stuff Well anyway Okay So they're all in court Long story short I mean I'm sure it was the longest 45 minutes of those plaintiffs lawyers's life The judge denies Russell Simmons's motion to dismiss No you didn't show up So denied stupid Like and I don't blame her You know the judge could have granted the motion to dismiss with no argument but denied There is this letter that Russell Simmons's lawyer writes on the day of the hearing and it's frantic 3:15 the hearing's done Motion to dismiss denied He didn't bother to show up And remember it was strong arguments and then my conspiracy theory 10 foil hat starts going like I'm just thinking about all the frankly like fantastic allegations about Jay-Z I've seen over the last few months It's like he has control over the court system and he can buy off every judge and make them not have to take a paternity Like all these big bad wolf stories like I mean I guess there's a greater than zero 0.00 chance some part of that is true So my tinfoil hat kicks in and I'm like what if Jay-Z logged in to the ecorts and unsubscribed the registered lawyers on the defense side because from personal experience I've seen a judge decide many motions to dismiss without ever having oral arguments So it could be decided without it So if the lawyer just truly never got a notification he could have just not known He could have just thought like "Oh my god." Yeah Imagine he was like in a deposition or he had like double scheduled like he was doing something Yeah Because like and and he didn't actually get the notification So this is his letter He says the day of the hearing that he missed This is like also just like remember this is Russell Simmons's lawyer like this is a a-list celebrity lawyer Dear your honor we represent the defendant Russell Wendell Simmons in the above referenced action We write in regard to the oral argument on February 5th 2025 Look at the date on the top of the letter It says "Oh you're not on there." Okay Well it's the same date We never received notice of this appearance and deeply regret missing the opportunity to argue our motion to dismiss At 2 Okay so this is where the frantic it starts getting Let me send it to you At 2:56 p.m a receptionist from our firm call uh received a call from your honor 2:56 p.m and notified the undersign that's him the lawyer that there was an appearance that we are tardy for He's writing right now that we are tardy for We are He's writing it right now where we are We immediately checked the docket and not seeing any scheduled appearance we took the following next steps They look like me trying to email Alex Spiro telling him how I anti-defamed JLo after I was defamed by saying I defamed her Here's my steps At 3:04 p.m we called the court your honor's chambers and there was no answer That sucks That freaking sucks They had till 3:15 The lawyer said "We called the chambers at 3:04 but he doesn't provide any evidence." I think he could have stapled a screenshot to the back True Could have been easy Would have been easy If I'm the judge I want to see the screenshot Let me see that you actually called at that time I'm not taking your word Sorry No there was no answer So still 10 minutes That had to be the longest 10 minutes of Russell I bet you he didn't tell Russell Simmons Unless it was a scheme but if this is like what it appears which is just like a oopsie Then 3:14 So they wait 10 minutes to do anything else I need to know You got to account This is active time I need to be calling I need to see 304 I called 304 30 seconds I called 305 I called 30 I need to see that I need to see I was calling with two phones for those 10 minutes What you took a nap 3:14 we called counsel for plaintiff Daniel Christino and there was no answer 3:14 we called counsel for plaintiff So to call all the lawyers called the main lawyer Kenya Davis She did not answer At 3:15 we called her again at her office line and she did not answer At 3:17 we emailed both councils for plaintiff and that we had received a call from your honors chambers and we were wondering if they knew of this appearance Y'all look at the date on this is this just happened two months ago and he had a strong argument That is the part that would really I would not be able to sleep at night if this was a truly accident This is such a snafu right okay Yeah I want to hear your theory Okay So at 3:17 we emailed both lawyers for the plaintiff that we had received a call from the court and we were wondering if they knew of this appearance as we had received no prior notice And all the while the judge and those people are all standing there with probably with their phones off cuz they're in court looking at each other At 3:25 oh look at look what it says At 3:17 we called We have not received a response He's writing it right now We have not received a response At 3:25 we called the clerk's office and spoke with several representatives One of the representatives stated there was no judge assigned to this matter See what I mean like is this true and transferred us to a supervisor But upon being transferred the call went to voicemail At 3:26 we called your honors chambers again and there was no answer So they only tried to call the actual court twice at 3:04 and 3:26 There wasn't like a parallegal like just like constantly like ring ring ring Okay hang up call again There wasn't one person and they couldn't have paid somebody on side of the street to do that for 30 minutes I'm just thinking all the stuff I would have done He said "Our contact information is up to date in the system We do not see any notice of this appearance as being scheduled The only place we have been able to find a record of today's conference is on the e court's website but that website does not list our correct contact information as reflected on the NYSCF and does not list Danielle Yuru as one of the defendants's attorneys Even on e courts we're unable to see any notice of today's appearance on the docket or when it was scheduled We sincerely apologize and intend to file a motion to reargue should our motion be denied due to our inadvertent failure to appear today And the next thing on the docket denied and then he filed a motion to vacate a motion to vacate the denial which is an order of the motion to dismiss So he wants the judge to open back open the the motion to dismiss so that he can argue that because he's saying it was a good faith accident and um papers were due for that The 27th of March was the last one So right now as we sit right now as we speak the judge is deciding Who knows she or he maybe has decided on this issue already by the time this video comes out But right now the issue up for the on the table is whether or not the judge is even going to open up Russell Simmons's motion to dismiss so that they can argue it or not Now he's made some strong arguments It should be back open back up But if the judge says no then it moves forward to where it even matters whether or not Oprah has anything of import or anything of value But it's in reading all of this crap that they're subpoenaing Oprah in the midst of all of this But if you go and you like look at anybody's coverage or any articles or posts or whatever like from mainstream media sources or whatever about this issue it's like there's a defamation case Oprah's getting subpoenaed because of that disagreement over you know why did she pull out was it at the suggestion or the pressure of Russell Simmons and all that but it's like nobody's talking about like Russell Simmons lawyer couldn't bear to show up to court Imagine you have more money than you know what to do with and you can't get your lawyers to show up But then of course there's conspiracy theories there's alternative theories So yeah um we're not even at the point in the proceedings where it even is certain whether or not Oprah's information is going to be relevant And I'm sure she's going to push back about wanting to I'm sure she's not going to want to sit for a deposition for this So she probably has lawyers that are going to you know
