Understanding the 609 Credit Dispute Letter

Have you heard of the 609 letter? If you haven't, I'm about to share with you exactly what this credit letter is, how it can actually chisel off negative things and reported information on your credit reports immediately, and why most people have never heard of 609. So, let's get into it. [Music] Okay. So, for those of you that have already tried the dispute process using the dispute letters that I offer to you for free as a free download at getdisdisputters.com or secretcreditlets.com which is down below in the description box. These are 100% free downloadable letters. And many of you have tried the process of disputing and not being successful. And so, if you're wondering, well, Monica, what do I do next? Well, I did do a video on the method of verification or the move letter, which is typically what you do next if you're unable to get things off of your credit report. However, there's another letter that you can consider. In fact, you can actually send this letter in lie of or instead of sending a credit dispute letter. You can send one to Experian, one to Equifax, and one to TransUnion. Be sure to always send these letters by way of trackable mail. You do not have to send the letters to the credit reporting bureau's certified, which is that green card, unless of course you're threatening to sue them. However, if you're not threatening to sue them, not yet anyway, you only need to send a trackable mail. So then that way you know when the 30 calendar days starts ticking, okay? Because they do have 30 calendar days to complete their investigation. So, let's talk about the section 609 letter. A letter that most people have never heard of. And again, you can use this if you're first getting started with disputing stuff on your credit reports. You can use this right away. You don't have to use any of the other dispute letters. In fact, again, go to get disputelet letters.com or secretcreditletters.com is a free download which is below this video in the description box. You can actually download those letters and look for the little box where you can get the 609 letter. It will be a newly uploaded letter for you. So, what's cool about this letter? In fact, this is the letter right here. It's fairly simple. And what a lot of people don't understand is that these credit reporting bureaus, they deal with thousands and thousands of dispute letters per day. Okay? And so what they typically do, especially when they want to buy themselves time, is they'll say, "Oh, well, they'll send you out a form letter stating that they don't believe that this is you, that maybe you're working with a credit um repair company, and that they don't think that this is really you that's filing this dispute or or, you know, requesting information about specific negatives on your personal credit reports." And so, they've been doing that a lot lately. Even though I tell everybody, listen, every single time you send any kind of correspondence to the credit reporting bureaus, which are Experian, Equifax, and TransUnion, you do need to include a copy of your current driver's license or a state ID card, ideally showing your current address. And if you don't have your current address on your driver's license or state ID card, take your happy ass down to the DMV and up upgrade it or get it get it fixed, okay? or you can use your passport card or a passport as long as it's valid because a passport as you know does not have your personal address on there. So that'll be neither here nor there. And then you need two utility bills showing your current address. Now you might be thinking, well Monica, I live with so- and so and so and so pays all the bills and the water and electric bill is in his or her name. Okay, great. So, you probably have a bank statement or a maybe a credit credit card payment or I don't particularly like credit card payments, but maybe you have a um car payment or some other type of documentation that's recent within the last 60 days showing your current address and your your name information. Now, I strongly recommend that if it's a credit card statement or if it's a bank statement, make sure that you get rid of all of your uh personal information. um when it comes to your account numbers, you don't want that floating around in the universe out there because of such heavy levels of identity theft in today's day and age. You just don't want that. And so, um you know, people ripping off your your credit card or your you know, obviously your bank account information. You do you do not want that. So, just basically make sure that you take a heavyduty um marker, you know, and block it all out. But that that's that's like second rate. I I usually like utility bills first and foremost. you send two utility bills in. But I've had people complain lately, especially lately, probably because the disputes are increasing in frequency with people that are trying to fix their credit right now because people are having credit problems at this point, especially post pandemic. So, I think what they're trying to do is kick the can down the road, give themselves an extra 30 days by sending you a form letter saying, "I still don't believe it's you. Even though you did send me your identification and you did send me two utility bills, I'm still going to choose to buy time." Um, so that's why I like the 609 letter because you can actually send the 609 letter instead of sending a regular dispute letter. And it basically not only just disputes certain negatives on your personal credit report, but what it does is it basically demands a full and complete profile, a full and complete file for every single negative that you are disputing. Meaning that they you basically want to know where they got this information. You basically want to know every single bit of I guess factual documentation or proof showing why they're putting this on your credit report. And the burden of proof is in fact on the credit reporting bureaus which again are Experian Equifax and TransUnion. So when you send a 609 letter which looks like this and by the way you can get it for free at getdisputletters.com or secret creditcredit creditletters.com. Hello which is down below in the description box and you can actually just get the letter. It says 609 on the little tab. We just basically click on that. So essentially what this letter is for is it it makes the credit reporting bureaus provide all of the information that they've acquired to be able to legally put this on your credit reports. This is beyond a dispute letter. Okay? A dispute letter basically says, "Hey, I believe that this is incorrect information. Therefore, I need you to investigate it or take it off." This goes a step further because it basically says that you need to not only investigate this stuff that I'm asking you to investigate, but it's also demanding to know exactly how you acquired this information, why in fact you're reporting this on my credit report and show proof from these these entities, whether they're banks or lenders, why they're showing this information on my credit reports. And then the burden of proof is on them to then go around like a chicken with their head cut off to get this information cuz I can guarantee you they don't have it. They do not have this information. And this is a step above just a run-of-the-mill investigation. Okay. The problem I'm finding now with a regular dispute letter is, like I said, the reasons I just mentioned that they're kicking the can down the road. They're trying not to do the investigations. They're getting thousands of investigation requests per day from people that are trying to fix their credit just like you. And they're just trying to buy time and they're trying to find ways of not being able to do it, thinking that you just read some $10 book that you got about credit repair off Amazon and you don't know about the next steps. And so that's why I'm I'm here with this channel for you to show you what you can do instead to show that you're not only higher educated and you know more about the credit system than your average Joe Blow and average Jane, but that you're willing to actually go forth and file a lawsuit. And yes, you do need to be prepared to file a lawsuit if in fact some of this stuff is not falling off your credit because this is damaging you. You're not getting even even down to insurance. Like if you are trying to get a better insurance quote for your car insurance, for example, your rates are going to be higher than somebody with good credit. Okay, that's just reality. That's how the algorithms work. Um, you might not be able to get that job you want because a lot of people are doing background checks to include credit. Okay? And so if they feel like you're a credit risk, they think, well, maybe this person's going to be, you know, embezzling money out of my company to pay these debts, or maybe this person's going to be stealing stuff out of my warehouse to be able to sell it on eBay to pay these debts, or whatever the case may be. And certain companies will not hire people that have a lot of negatives on their personal credit reports. And so, not only are you getting ripped off on interest rates and not able to use credit to the maximum degree, especially when it comes to wealth building, which I'm talking a lot about now on my channel, and how to use business credit to build wealth, other people's money or OPM. And yes, all the millionaires and billionaires do it. So, if you're like, "Oh, I just want to be a cash pay person and pay cash for my business and pay cash for this and that." You're not going to get very far as far as building wealth. I can guarantee you right now because there's only so much you could pay cash for and it's just a really slow row to getting a business going and being successful with a business if you're trying to do cash for everything. Trust me, the people that are highly leveraged out there, the people who are super wealthy, they're not taking money out of their savings account for any investments or any of that. They're borrowing the money, okay? And that's why they're as rich as they are because they understand how to play the credit game through the low loopholes. And so if you don't understand how to even fix your personal credit, because a lot of the credit that you're going to be able to get, even on a business credit level, a lot of it hinges off of your personal credit. So if you can't get your midfico score up over 720 and ideally over 750, I know some of you are signing like, "Oh no, I don't know. This is like a long long haul for me. I'm I'm at a 350 or 450 or whatever the case may be." Trust me, if you stick with all of this stuff over the course of a 12-month time frame, even doing your yourself over and over and over again, sending these kinds of letters, this stuff will start chiseling off. Okay? So, you just have to be consistent and patient with the process. This is exactly what I had to do when I filed for bankruptcy back in 2003. So, it's been way more than I well way not way more than, but it's been 20 years, 20 plus years. And when I was rebuilding my credit, I did exactly this stuff. In fact, I didn't even know about the 609. This is just something that is more recent. These are different little tools that I didn't even have available to me back in the day because I didn't have anybody teaching me how to do this. I learned this on my own by learning my own unorthodox ways of doing this credit fixing business and rebuilding business because I really wanted to be an entrepreneur that was successful and being able to access that business credit to start getting into some heavy duty highle investments for cash flow as well as building additional businesses out. So you can't play that game if you can't get your personal credit in order. That's just reality folks. That's just reality. So, if you are in the fours and the fives, don't worry because you can literally increase your FICO score by hundreds of points just in the next few months. A lot of people are like, "Ugh, I'm a 550. That's going to take forever." Not really. Because if you increase your credit score by 200 points, which is not that difficult to do, you can do it in about 90 to 120 days by following everything that I share with you on this channel. You can have that 750 within a couple two three months. Okay? But when you're sitting on your dead ass doing nothing about it, well, you know, you're not going to get anything. Okay? Now, I'm not saying that you are in particular, but there's a lot of people that just I don't I don't I don't even want to do it because it seems like it's overwhelming. Well, then then you already lost before you even started. Okay? Not asking you to kick in hundreds of dollars a month to pay a credit repair company. I'm not asking you to do anything that's ridiculously expensive or hard to do. All this is very easy to do if you just follow the instructions. So, you're probably thinking, "Okay, well, Monica, what are the instructions?" Oh, so let's get into the very, very bare minimum. what what you need to do here. Number one, you need to pull your personal credit. If you haven't done so already, I highly recommend you spend the $39.99. It's a onetime fee to Experian. You can get all three credit reports and all three FICO scores. If you decide to use some other random, you know, Credit Karma or whatever, they're probably not going to report your FICO score accurately and it's not going to be really easily downloadable as a PDF to where you can print it out and actually go through all the misinformation that's on your credit report, all the negatives that are on your credit report, all the hard inquiries that are on your credit report, things that you need to have updated, changed, or removed. So, I like to pull all three. And you know, you pay the onetime fee of $39.99. You get all three FICOs, all three credit credit reports. People ask me, well, what's the difference between just getting my free annual report? Free annual reports don't have FICO scores. Okay? So, if you want your FICO score to see where I am before and after, I mean, I don't know about you, but if I was on a diet weight loss program, I'd want to know what I read on the scale today and what I read on the scale eight weeks from now when my program's over. So, you can't tell if you're successful with all this stuff if you don't have a perimeter or some kind of guideline to start with. And so, the FICO score is a really good way of doing that. So, number one, pull all your credit reports. Uh, number two, print them all out. And I like to highlight everything that's that's not accurate, like any name information, any address information, any old phone numbers. You want to send a separate letter that should be your first letter along with a copy of your current driver's license and a copy of your two utility bills. It does not have to be trackable. This first uh letter and it's basically updating your information. So, anything that's wrong, any aliases you never used, any alternatives to your social security number that's not correct. A lot of times when you're at different car dealerships, for example, or you're, you know, maybe you're at a bank and you're trying to apply for a loan, sometimes the people behind the counter are like typing in information and your name gets transposed in some way. Your social security number gets transposed. And so when you have all these extra social security numbers that you've never gone by or never tried to use, it makes you look bad like you're trying to run some kind of fraud scheme, you know? So what you want to do is remove all that stuff. Just say, "No, I never used this social security number ever in my life. I don't know why it's on my personal credit report. I have never had this address. Even if it's a transposed number, for example, I've never used that address. I've never used this name." Like for example, um years and years ago, somebody typed some bank loan application in wrong and they they they they typed my last name in incorrectly and it showed up on my credit report for years after that because I didn't know that you can just simply send a letter saying I never went by this name. I never had this middle initial. I never had any of these things that are on this. And so cleaning up even your personal information can help a lot as far as increasing your FICO score. A lot of people don't even realize that. Remove all old phone numbers because if you have to call any of the credit reporting bureaus for any reason, they're going to refer to your phone number. And if you have some old phone number you haven't had for five years, they're going to be like, well, you know, we can't even verify that this is you because, you know, you don't even have that phone number. So, you know, get rid of all old phone numbers. Make sure that they have your current cell phone number, your current home number, and you want to make sure that they have your current address as well. So that's first and foremost the very first thing you need to do is straighten out any of the personal information that's inaccurate on there. That's one letter that goes out one to Experian and one to Equifax, one to TransUnion. Send that out with a copy of your driver's license and two utility bills. Does not have to be trackable. Next, you can immediately start working on your dispute letters to include just the 609 letter. Okay? So again, you can download it for free at getdisputers.com or secretcreditletters.com. down below in the description box below this video, you will see both those links and you just look for the 609 button and you download this. Okay. Now, mind you, please note that this particular letter has all three credit reporting bureaus on there. This will be a Microsoft Word document that you will be downloading, which means that when you are sending it to Equifax, for example, you want to remove these other two. Okay? Hello. Some people just don't know how to do this kind of stuff. It's called basic editing. And so then when you also when you want to not send it to Equifax, you want to send it to Experian, you get rid of the other two and you keep doing this. You want to make sure obviously you put all your personal information at the top. Okay? And then you also want to be able to put any and all negative accounts in in this area that you're going to be disputing and that you're going to be demanding that they give you the section 609 information on. Okay? So, let me be very clear on what exactly the 609 statute is. I'm going to show it up on the screen right now for you. So then that way you can get an idea of exactly what this is. So basically it says under section 609 of the Fair Credit Reporting Act 15 US code 1681G. I am exercising my legal right to request full disclosure of all information contained in my credit file. This includes the s source of information, original creditor details, and sign contracts or applications associated with the accounts listed below. And then you're obviously going to list the accounts. Now, maybe you have five different um accounts that you want to dispute. Ideally, you'll focus on closed accounts. Okay? Whenever you focus on doing your initial round of disputes, I always tell people to focus on closed accounts. You don't want to focus on open revolving accounts or trying to deal with late pays or anything like that. Just focus on the closed accounts, especially with credit collection agencies. Those are typically the easiest to get off. And then you can focus on the rest of the stuff later. Okay? You can even add a bankruptcy because that's technically considered closed as long as it's been legally discharged by a court of law. Um, you can also include a repossession as long as that's already been done and over with. You can also include a uh foreclosure as long as that's done and over with as well. So, you definitely want to include every single one of those accounts are going to be separate. You're going to include the name of the creditor or debtor or collection agency, the partial account number, not the whole account number. Exactly the way it reads on your credit reports is exactly how you want to post it. And the amount that they're claiming that you owe. Okay? Those are the three pieces of information you need to include include and it can be on one line. Name a debtor, amount that they're claiming that that you owe and the partial account number. Okay? And then you do like all the different lines. So if you have five different credit accounts that you're going to be disputing, then there's going to be five different lines. All right? I like to line them out and space them out a little bit just so then that way it's not all, you know, bundled together. And then what you want to do is make sure that you include um again you have to include your driver's license, state ID, passport, something that's a current ID issued by the the government in some capacity and two utility bills or alternative, you know, al alternative documentation showing where you live. This is really important because like I said, they will try to kick this can down the road. Okay. So then basically what you'll do is you'll send this after you're done with your letters. You'll sign it. I don't like to legally sign anything when it comes to the credit reporting bureaus, but especially if you're going to ever communicate with creditors or collection agencies, definitely never include um your legal signature. And so and and by the way, if you're ever going to be in communicating at some point in time with creditors down the road, maybe uh you definitely will not be cons uh including your your ID cards or any of that stuff. That's just for the credit reporting bureaus that you're going to be including that information just to prove where you live. So, it's okay to send that to the credit reporting bureaus each time you communicate with them, but don't ever send that documentation to a creditor or collection agency. That would be um a death sentence. Okay? So, you definitely want to send this and you want to make sure that you send it by way of trackable mail. Okay? And like I said, just scribble your name like like some kind of um alternative version of say your initials at the bottom. I I'm paranoid like that. I don't like that. Some people argue. They're like, "Well, Monica, you know, my my ID has my signature on it." Okay. Yeah. Does anybody have a microscope? I don't know if you've noticed lately, but state issued IDs have some tiny little rendition of your signature because they make you sign in a box that's this small. And none of us sign that small. Well, maybe a few of you sign that small. The rest of us don't sign that small. I I sign pretty big. So, when I'm trying to sign in some tiny little box at the DMV and in some digital version of my signature, it's not actually my legal signature the way I would actually sign a check, for example. So, don't be paranoid about them, you know, comparing or all any of that stuff because you could just say, well, you know, I just initialed the letter, but you know, my ID has a signature on it. Whoopdedoo. Okay, so don't be par paranoid or panicked about that worrying about your signature on your ID. That's not a big deal. So, then what happens? So, you mail this off. Okay, you mail this off in it could be a number 10 envelope. Does not matter what kind of envelope needs to be sent trackable mail. Trackable does not have to be certified. It could be trackable and you wait 30 calendar days from the day after they receive it. So, for example, if they received it on the first of the month, the calendar clock will begin on the second of the month and you have to wait 30 calendar days. It's not 30 business days, it's 30 calendar days, okay? and you just wait and you see what falls off the credit. All right? And so they might send you a letter saying, "We don't believe it's you," blah blah blah blah blah. In which case, your next letter, if that ever happens, needs to be a very strong legal letter. So, it would be this letter plus a really strong box that would be at the toward the bottom. Just say, "Hey, I received this uh this notification from you in the mail stating that you don't believe that this is me. Yet again, here's a copy of my my state issued ID. Here are my utility bills within the last 30 days. There's absolutely no excuse as to why you're not giving me this documentation. So therefore, if I do not receive this documentation as per my request as per federal law, I will be filing a lawsuit against you for maximum punitive damages. Um, you know, whatever the the whatever the government would will would allow for. So, if you ever have an issue where they're not willing to or not able to or sending you the information you're asking for, you send them a lawsuit notification letter. Period. And all of those problems will go away. They will start to furnish you the documentation you're requesting. You will find that with this secret 609 letter, a lot of stuff will fall off way more than you'll ever find with a general dispute letter just because you're citing specific case law that has to do with full disclosure, not just partial disclosure, not just, oh yeah, we did an investigation, but um just trust us, we did an investigation, you know, and then here's your updated information. not showing any proof of how they did the investigation, any contracts, any agreements with the credit the creditors or the collection agencies, nothing. And that's why I always tell people, listen, it's always best to go after the closed accounts, especially collection agencies. The collection agencies don't have a signed agreement on in any of their folders anywhere. They don't have any any any of that because the original debtor does not give them that when they transfer the debt. And a lot of people don't know this, but credit collection agencies cannot go back to the original debtor to get the original contract. They have an agreement where they're like, "Hey, we're selling you this debt. You're on your own." Okay? So, if you collect on it, great. If you don't, oh well, that's your problem. That's, you know, welcome to the world of risk, right? So, if a credit collection agency goes back to the original debtor saying, "Hey, I need paperwork." the original debtor is not going to help them collect. They're not. That's not part of the agreement. So, a lot of people don't know, but collection agencies are the easiest to have removed off your credit report because they can never get the documentation that the 609 letter is requesting. Okay. So, the good news is that you have the credit reporting bureaus based on this letter. They're asking them, hey, we need contracts. We need proof that this account belongs to them. And the credit the credit collection agencies are going to be like, well, we're screwed because we don't have any of that. You know, we can't even get any of that. as per our legal agreement with the original debtor. So you again just focus on all your closed accounts right now. Focus on everything that's closed that's showing up as negative charge offs. Um like I said, foreclosures, uh repossessions, that kind of thing. Even a bankruptcy. Yes, even a bankruptcy you can you can because then they have to go back to the court, especially if it's more than 2 years old. Many of these courts don't actually have the paperwork anymore. So, if it's been discharged more than two years ago, you have a really good chance of potentially getting that bankruptcy removed. Okay. So, this is the 609 letter. Again, you can go to getdisputters.com or you can actually go to uh secretcreditletters.com. Down below in the description box below this video, you will see one of those two links that you can actually get this letter. Look for the button that says 609. Download it. It'll be a Microsoft Word document. And make sure you do the proper editing to make sure that your information looks professional. And again, don't forget your driver's license, a copy of that, two utility bills, and that you're going to be sending this trackable mail. Make sure that you do that. Very, very, very important. And then, and then you wait, you wait the 30 calendar days. And you'll notice a lot of things will fall off. Some things will not fall off because they will actually show the corroborating ev evidence that you actually have this account, that this is your account, in which case we take the next steps. We do the method of verification letter. We do other things. Don't just give up. This is a process. So, in addition to you working on your credit, if your FICO score is high enough, you definitely want to consider getting one of those second chance credit cards, at least one, to start rebuilding as you're chiseling off. That's a big mistake that I see a lot of people make. A lot of my students in credit make where they're fixing their credit and they're removing a bunch of accounts, but they're not starting new accounts to start rebuilding credit. Furthermore, if you have any accounts that you have open and revolving, make sure that you pay those credit cards on time. Don't don't get in this mess. Don't continue facilitating the mess that you're in right now. Make a commitment to do better. Okay? And then that's how you slowly but surely pull yourself out of this mess. All right?
