today we will cover republic act number 9173 this law has nine articles but we will just focus on its most important points mainly this lecture will focus on the most common concepts in the board examination and the concepts that you can use on your journey as a professional nurse in the philippines let us start with article 1 which is the title of this law according to section 1 of the ra9173 law this act shall be known as the philippine nursing act of 2002 this will be an act that will provide for a more responsive nursing profession and also this act will repeal republic act number 7164 which is also known as the philippine nursing act of 1991 so now republic act 7164 is considered as null and void because we now have the latest law which is your ra9173 law so that is the first article we now move to article 2 which is the lost declaration policy according to section 2 of the ra9173 law the government shall be responsible for the protection and the improvement of the nursing profession the government should do things to improve nursing education and the nurses working conditions the government must ensure that the schools that are in operation are following at least the minimum standards in order to produce well-equipped professional nurses in order to protect and improve the working conditions of nurses the government must ensure that there are better career prospects and a dignified existence for nurses in addition it is the government's responsibility to guarantee that there are enough nurses to deliver quality basic health care in other words the government is responsible for making sure that there is appropriate nurse patient ratio in hospitals to put it simply this law is designed to make the nursing profession more responsive the third article which is packed with a lot of very important concepts that are very common in the board exam provides for the organization of the board of nursing this article stipulates that the professional regulatory board of nursing shall be created to regulate the nursing profession in this lecture the professional regulatory board of nursing will be known as the bon or the board now what is the process for appointing individuals to be part of this regulatory body per vacant position the pna which is known in the law as the accredited professional organization will recommend three of its most qualified members to the position this list from the pna will be submitted to the prc which will now nominate two from the three p a recommendees lastly the names of the two nominees will be submitted to the president of the philippines the president will finally appoint one of the two nominees to the set bon position in the ra9173 law the composition of the bon is one share person and six members now board exam question alert if you will be asked in the board examination how many persons compose the bon your answer should be seven because the board of nursing is composed of one shared person and six members so what if all the seven positions in the bon are vacant then the pna must submit a list of 21 recommendees to the prc and then the prc will nominate 14 out of those 21 recommendees and then the president will appoint seven out of those 40 nominees and we now have completed all the positions in the board of nursing now what are the qualifications needed if a person wants to be a member or the chairperson of the bon first on the list is that he should be a natural-born filipino citizen and a resident of the philippines now let us differentiate between a natural born and a naturalized citizen natural-born filipino citizens are filipino citizens who did not perform any act to acquire their citizenship so if a person did not apply if a person did not perform any act to acquire his own citizenship then he is a natural-born filipino citizen how can this happen if a person is born of filipino parents or at least one of his parents is a filipino then there is no need for him to apply for his citizenship because automatically he is a filipino citizen by blood this principle is known as use sanguinis the right of the blood using this principle citizenship is determined by the nationality of one or both parents this is used in the philippines while the principle of use soli the right of the soil is when citizenship is determined by place of birth this principle is used in the united states of america a person is automatically an american citizen if he is born in an american territory however if you applied so that you can have your new citizenship then you are a naturalized citizen this can happen if a person has a different citizenship but he wants to be a filipino citizen or a former filipino who denounced his citizenship to acquire another but now wants to repossess his filipino citizenship question from what i have just discussed can a person change his citizenship from time to time the answer is yes but can a person change his nationality from time to time the answer is no citizenship can be changed because it is considered to be a political term while nationality is an ethnic term therefore it cannot be changed that is the first qualification very basic you must be a natural-born filipino the next accolade that will qualify a person as a bon is to be a registered nurse with a master's degree he can be a registered nurse with a master's degree in nursing a registered nurse with a master's degree in education or a registered nurse with a master's degree in any allied medical health profession so for example these are the members of the bon is this an acceptable composition as according to the law we have three members with a master's degree in nursing and the other four has either a master's degree in education or a master's degree in other allied health professions well according to the ra9173 law this is not acceptable why because according to the law the majority of the bon must be an rn with a master's degree in nursing when we say majority it means one more than half of the members so in this case at least four of the bon must have a master's degree in nursing therefore we need to replace one of the members with another with a master's degree in nursing now is this an acceptable bon composition the answer is still no why because the law also states that the chairperson must have a master's degree in nursing so this two will just have to switch their positions now basing it again on the ra9173 law is this roster now acceptable the answer is yes but you must also remember that the law requires that the board must represent the three fields of nursing namely nursing education nursing service and community health nursing so that is the second qualification the third qualification is that the person must be a member of good standing of the philippine nurses association by the way the philippine nurses association is referred in the ra 9173 law as the accredited professional organization nurses must renew their p a membership in time memberships can be renewed annually or every three years also there is what we call lifetime p a membership and that is the third qualification next is self-explanatory the person aspiring as a bon must have at least 10 years of continuous practice of the nursing profession with the last five years in the philippines meaning if you are already practicing the nursing profession by the age of 19 and you continued your career in nursing for the next 10 years here in the philippines then by the age of 29 you will already have 10 years of continuous nursing practice and therefore you already possess one of the qualifications to be part of the board of nursing here is flory age 29 saying nursing isn't really stressful at all the last on the list of qualifications is that the person must have never been convicted of any offense involving moral turpitude so what are crimes that involves moral turpitude these are crimes that have an inherent quality of baseness vileness or depravity with respect to a person's duty to another or to the society in general in other words any act that is contrary to the law any act which is done contrary to justice honesty modesty or good morals involves moral turpitude and here are some examples of these crimes or offenses abduction with consent smuggling rape estafa or falsification of documents bribery profiteering robbery murder illicit sexual relationship with fellow worker drug pushing so those are the five qualifications that are needed if a person wants to be a part of the board of nursing the first is that he should be a natural-born filipino citizen not naturalized but a natural-born filipino citizen second he must have a master's degree in nursing education or any allied medical health profession third he should be a member of the p pna fourth one is that person must have at least 10 years of continuous practice with the last five years in the philippines and
