Article 6 of ECHR: Fair Trial Rights

hi folks so what we are here to look at today is article six this is the a01 so article six um is quite a lot of information but I'm going to split it into article 6 and then I'm going to do UK domestic law so the way human rights works is um there's the Articles and then you've got UK domestic law that kind of marries up with the the Articles okay so article 6801 so remember this is the right to a fair trial article 6 e c h r um I would always put in that the Magna Carta 1215 gave the right to trial by jury so start off by stating article 6 subsection one that the accused has the right to um or the defendant I guess if it's a civil case as well has the right to an independent and impartial Court I would back that up with Pinochet where the judge was not impartial remember he was um involved in Amnesty International and that's human rights organization and Pinochet big abuser of Human Rights Julian dictator so independent and impartial Court um your case has to be heard within a reasonable reasonable period of time has to be heard in public and it has to be fair and I would also say there should be a quality of arms and I would quote Steele and Morris Okay the third Point disclosure of evidence has to happen unless it's a an issue of National Security I would then look at article 6 subsection 2 and state that the defendant in a criminal case is Presumed Innocent so you are innocent until proven guilty the burden is on the prosecution to prove your guilt worth mentioning as well that you have the right to silence and the right to not self-incriminate okay moving on to article 6 subsection three now I would list a to e so these contain more rights for the defendant you are so six three a you have the right to be informed of the accusation promptly in a language you understand 63b you should have adequate time and Facilities to prepare your defense you have the right to call witnesses and attend the trial article 6 3 C free legal advice but just remember this can be um denied which is Ibrahim 6 3 D you have the right to examine and cross-examine Witnesses and 6 3E you have the right to a free interpreter um also worth kind of mentioning Thompson and venerables how the fact that they had an unfair trial because they were treated as adults so it's really important that you should be able to understand the court proceedings so that is the basic information of article 6 tune in for the next video which is the a01 for UK domestic legislation
