Missouri Cannabis Regulation Overview

Purpose

  • Patients with qualifying medical conditions can freely discuss and use medical marijuana under physician supervision.
  • Adults 21+ can access marijuana.
  • The Department of Health and Senior Services ensures patient/adult access subject to restrictions.

Article XIV Implementation

Consumers

  • 21+ can purchase/possess marijuana products.
  • Can obtain cultivation authority.

Qualifying Patients

  • 18+ or emancipated minors can get medical marijuana ID cards.
  • Non-emancipated minors need parental/legal guardian consent.
  • Can cultivate with exceptions.

Medical Marijuana Patient Identification Cards

  • Validity: 3 years.
  • Certification: Necessary by a physician/nurse for medical condition.
  • Patient Responsibilities:
    • No smoking in public unless allowed by law.
    • Cannot be a primary caregiver if under another caregiver’s care.
    • Notify department if they no longer wish to hold an ID card.

Non-emancipated Qualifying Patients

  • Require parent/guardian written consent for certifications and ID card.
  • Parents/guardians must administer marijuana use.

Primary Caregivers

  • 21+ can get an ID card to assist up to six patients.
  • Can cultivate on behalf of patients.

Caregiver Responsibilities

  • Serve up to six patients and ensure ethical marijuana access.

Purchase and Possession Limitations

Consumers

  • Purchase up to 3 ounces per transaction.
  • Possess up to 3 ounces unless cultivating; excess must be in a locked facility.

Qualifying Patients and Caregivers

  • Default purchase: up to 6 ounces/month unless authorized for more.
  • Can possess a 60–90 day supply.

Cultivation

  • Authorization required for consumers, qualifying patients (not minors), and caregivers.
  • Cultivation must occur in an enclosed, locked facility.

Cultivation Limits

  • Consumers: Up to 12 plants (flowering and non-flowering combined) at a residence.
  • Patients/Caregivers: Up to 12 plants; separate limits per patient.
  • Labels and secure storage are mandatory.

Identification Cards

Application

  • Electronic applications; unique ID numbers assigned.
  • Qualifying Patient/Primary Caregiver:
    • Includes personal information, certifications, and consent where required.
    • Includes photos and government ID.

Renewal

  • ID cards valid for 3 years; cultivation cards valid 1 year.
  • Renewal requires updated applications and fees.

Penalties

  • Revocation for false info, exceeding limits, or illegal activities.
  • Sanctions include fines and card suspension.

Authority

  • Based on sections of Article XIV of the Missouri Constitution.
