To file RTI in an effective manner Which are the 3 - 5 things you need to know 2. How are you supposed to file offline RTI 3. My name is Rishabh Jain You are watching Labour Law Advisor And before we move ahead Don't forget to subscribe to our channel Like our video, and press the bell icon [Intro Music] Before filing any RTI Firstly, you need to remember a few things Which will form an effective RTI You might draft your RTI in such a way By turning it around With this, the PIO might not provide you with information He will create a path And this is quite a common case If we don't know how to write RTI effectively Friends! To write RTI in an effective method You need to remember 4 simple things 1. Keep it simple So then your RTI It should be very simple and basic As basic as a shopping list If you ever go shopping, then you prepare a list That I need this, this and this Similarly, your RTI should also be simple By turning/ twisting and introducing Or to make them understand Why do you want to gain this information Writing such lengthy explanatory questions There is no need Make it very simple and basic For eg: If you want to retrieve PF's transfer-related detail Then, write RTI like this i. What is the step-wise progress in my PF transfer application? Since, I submitted it on a certain date ii. Mention the name of the Officer with their contact number Whom this application has been lying around iii. As per your Citizen Charter As per the rules and regulations of PF Department In how many days the PF transfer application must have been processed? If you write this, then you will receive better answers Rather than you write My PF transfer application has been delayed Since so many days I visited the PF department so many times I called the PF Department and no one has reverted with my query etc etc If you write the entire story then it will be difficult for you to get an answer If you just ask, What is the status of my PF transfer? Then anything can be said in this You ultimately want that Your work should be done Or you receive the correct information Then keep your language simple And at the same time, keep your emotions afar Keep your pain and worry aside Pensioner, Please don't write this in RTI That I have struggled so much and now I am ultimately filing RTI I went to this department, that department PIO doesn't have any relation to that Your RTI should be simple, basic and bullet wise 2. Keep it short You need to remember that Ultimately, the one who is replying from the department site He is a PIO and a human like you Assume that If you are a PIO Who is providing the information And you receive a long application Wherein there are endless questions Then, what will you do? You will slam it on the drawer You will try to delay it That somehow my work But, If small information If you ask short questions So that the PIO will be able to answer quickly Then there is a high probability for the answer to reach you Hence the 2nd point is Keep it short 3. Divide and Rule Assume, you still have a lot of questions You have 25 - 30 questions with the Govt department So what do you need to do? You should file multiple RTI Let every RTI consist of 3, 4 or 5 questions Let them get answered File the next RTI Then File the next RTI Why is there an advantage The advantage is If it delays the RTI for one day PIO Then, Rs 250 penalty is levied If you ask 20, 25 or 50 questions in one Even then Rs 250 penalty will be levied Rather, If you divide your RTI in different parts Then, the penalty on this information will increase a lot Hence, you need to Divide and Rule as well 4. Don't be over-ambitious For eg: If you need particular information of a year For eg: If you want to retrieve Gun license detail How many gun licenses have been issued? In our state, in our city Then, don't ask for the information in a way All Gun licenses issued since 1980 The next person will have to remove files from 30 - 40 years It will take time for them to check all the documents If you need actual information The amount of time that you require it for The concise way that you need it If you send that, you will get the information on time Friends! We will move on to the next topic How should you file RTI? Then, most Government departments Even centre They now provide online RTI options But, online quite easily You can file your RTI We will talk about that But, still A lot of the state departments and multiple ministries and departments Have still not become online And for them, we need to file an offline RTI But, you don't have to worry about that either It is very easy to file an RTI It has 8 simple steps I shall explain you each step Firstly, identify in which department and which ministry do you want to file the RTI Retrieve that information via Google Who is the Public Information Officer there? And you have to file an RTI on his/ her name 2. Preparing the RTI The RTI that you need to prepare You can prepare that on a plain sheet of paper You can prepare that in any language Either English or Hindi And you can write your questions in a simple manner You just need to make sure that You need to "To" and "From" very clearly And you need to write your communication detail Through which, RTI should reach you Your Email ID, your Phone number Your Address etc In few particular states There are certain formats or forms Through which you need to file the ITR Below, we will mention a link to our blog We will give you a link Wherein you will find rules of multiple states and you will find forms too With forms, it will become easier for you That you know, what the structure is And you need to write the query in the prescribed place Few states prescribe this form And in few states, there is no particular form You can write the RTI on a plain paper You need to ensure That you mention You are gaining this information Right to Information Act 2015 3. You need to ensure Proper Addressing Which department are you asking for the detail from? You need to correctly mention the PIO Detail Assume that You process the application in a wrong department Then, it's the responsibility of the PIO there To forward your information to the correct department Assume, even If you make a mistake Even then you don't have to worry You work will still get done But, your work should reach the correct place the first time Your work will be done quickly 4. How to frame the RTI? Then, firstly write a draft Get 2 - 3 iterations of that draft Make it simple and write point-wise/ bullet wise And it's not like, the 1st time you wrote You send the RTI accordingly Hence, it's better you first write a draft Keep it on your table for 1 or 2 days Read it yourself and show it to your friends or Advocate once And then send the RTI ahead 5. You need to pay fees with this It's very easy to pay the fees I told you, via Indian Postal Order Or else Through Court fees stamp The court stamp of Rs 10 You can apply that too In few states, you can even add Demand Draft 6. Write your own Personal Information At the end your information Like I told you, Address, phone number, Email ID etc You need to write all of these 7. Handing it over Once you draft this RTI properly Then you can send this via Speed Post Or you can personally send it to your PIO department Remember one thing You get a photocopy of your RTI done If you are handing it over personally Then attached a received seal So that you can prove On which date did you send it Or If you are sending it via Speed post Then keep it's receipt carefully So you are able to track On which date did the officer receive it From that until 30 days, the timeline starts 8. Response of RTI After filing RTI once You will receive a response within 30 days This response will be mostly in hard copy With you by letter or by Speed post - You will receive it Now we will talk about - How to file RTI online In the central or state government Which is very important Which you can file within 5 - 10 minutes at once Once you know everything Firstly, you need to visit: rtionline.gov.in website Here you need to sign up Sign up here Your name, your password Email id, User id, Name, gender, address, PIN code Country, state, status Education status, phone number Mobile number All of these things will be asked Once you submit it Then an OTP on your email ID Or a verification link on your email id After that, your login id will be created I have already created that So I am directly signing in After signing in You need to click on "Submit request" Firstly, as I told you Keep your draft ready What do you want to ask After that come and submit it here If you click on Submit request Then they will ask you few basic details Guidelines Firstly, web portal can only be used by an Indian citizen Anyways, the RTI Act Can only be levied on Indian Citizens And here it is said that The number of ministries/ departments of the Government of India This portal can be used for them The condition that is written on text They could be a maximum of 300 characters If it's more than that Then you can attach that to your supporting document But, as I told you As much short and sweet as your RTI will be The more chances to get a quick reply Ahead, there is a payment option too Wherein internet banking, debit cards etc All these facilities have been given to you It is also said that If there is any type of additional fee levied on you Then CPI will inform you Via email As I told you, Rs 2 per paper copy How many copies are there exactly You will get the information about that later After reading all this Scroll here at the condition and click on Submit After submitting If I give you an example Through which department do you need to submit your RTI This is important for you to know For eg: Provident Fund You need to apply a request for Employee Provident Fund Then it comes under the Ministry of Labour Firstly, you need to search Ministry of Labour & Employment And after that you will find Employee Provident Fund here You can check Employee Provident Fund here You can also see ESI here Similarly, you will also have to find In which department, do you have to file your RTI After that you will have to select an appropriate department/ ministry After that, your basic details, education, qualification Etc. All of that you will have to fill You will have to add phone number etc And now we will come to the start Then, here you need to fill the RTI Pay attention here, Only alphabet A to Z Number 0 to 9 and are only allowed in Special character Apart from this, there are no special character's allowed Most of the times, you will fill this Apart from that If you use any special character, then you will keep receiving errors You need to attach a file with maximum 3000 words Here, you can attach a PDF File Upto 1 MB Fill the security code and submit After submitting, you will get the payment option After going here, you can do the Rs 10 payment option Hence, your simple RTI has been submitted After submitting the RTI Once you arrive at the home screen Then you will find the RTI here Here it will show as a Registered The number of RTIs are listed And you will find the pendency here That 2 are pending And when it is disposed That is when you receive the answer from the department Either via courier or speed post Then it will come in the disposed status here You can click on the RTI number here You can check the status here too For eg: I have filed 2 RTIs One with North Western Railway One with Employee Provident Fund I am able to check that here And all the RTI details have opened here Here you can check it's current status too By clicking here Until your process is done Once the process is done, it will disposed off here Here you can see, Request has been disposed off On 9/3/2019 And I filed this on 19/2/2019 That is within 20 days, it has been disposed If you are not satisfied with your RTI disposal Or you don't receive a reply within 30 days Then you can submit First Appeal here The guidelines to it are given here And you will have to click on Submit You need to fill your RTI request number here You will have to mention your email id here And add your security code here And after that you can register your appeal here So this was the overall online RTI registration process Stay connected with the Labour Law Advisor channel this way Stay Jagruk!
